Important Update: ICE Changes Rules on Form I-9 Penalties

US Immigration and Customs Enforcement (ICE) recently made a major shift in how they handle Form I-9 mistakes. Many errors that were once considered “minor” and fixable are now labeled as substantive violations {ICE Form I-9 Inspection Fact Sheet, March 16, 2026}.

 

 

This means employers can now be fined immediately for these mistakes without being given a chance to fix them first {INA § 274A; 8 C.F.R. § 274a.2}.

What Has Changed?

In the past, if ICE found a small mistake on your I-9 forms, they would give you 10 days to fix it (the “cure period”) {Virtue Memorandum, 1997}. As of March 16, 2026, ICE has reclassified over 10 common errors. These errors are now subject to immediate fines ranging from $288 to $2,861 per form {Federal Register, Jan 2, 2025; 8 C.F.R. § 274a.10}.

 

 

Major “Technical” Errors That Are Now “Substantive” (Fined Immediately)

If these fields are missing or wrong, you are now at risk for an immediate penalty {ICE Fact Sheet, March 2026}:

 

 

  • Section 1: Employee Date of Birth, USCIS/Alien Number, or the date next to the employee’s signature.

     

     

  • Section 2: Missing document titles, numbers, or expiration dates—even if you kept copies of the documents.

     

     

  • Certification: Missing the employee’s first day of employment.

     

     

  • Employer Info: Missing the name or title of the company representative.

     

     

  • Remote Verification: Failing to check the “Alternative Procedure” box or using remote verification while not enrolled in E-Verify.

     

     

  • Electronic Systems: Any errors in your electronic I-9 system’s audit trails or security protocols {8 C.F.R. § 274a.2(e)-(i)}.

     

     

Warning: Keeping copies of documents used to be a “safety net” {Virtue Memo, 1997}. ICE has eliminated this rule. The data must be on the form itself, or it is a violation {ICE Fact Sheet, March 2026}.

What Still Counts as a “Technical” Error?

A few minor mistakes still allow for a 10-day window to fix them {ICE Fact Sheet, March 2026}:

 

 

  • Missing the employee’s Social Security Number (unless you use E-Verify)

 

  • Forgetting to write the employee’s name at the top of Page 2.

     
  • Missing the employer’s business address in Section 2.

     
  • Failing to list “other last names used” by the employee.

     

     

The Financial Risk

Because ICE is currently increasing the number of inspections, the financial stakes are high.

  • Example: A company with 200 I-9s containing these newly “substantive” errors could face fines between $57,600 and $572,200 {Calculated based on 2025 Inflation-Adjusted Penalty Scale}.

Since you can no longer wait for an ICE audit to fix these mistakes, proactive correction is your only defense.

 

 

  1. Conduct an Internal Audit Now: Fixing errors before ICE arrives stops the “continuing” nature of the violation and starts the 5-year statute of limitations clock {28 U.S.C. § 2462}.

  2. Commit to Fixing Mistakes: If you find mistakes and ignore them, ICE may view this as “bad faith,” which leads to higher fines {INA § 274A(e)(5)}.

  3. Review Your Electronic I-9 Software: Ensure your system meets all DHS security and audit trail standards.

  4. Update Training: Make sure the people handling I-9s know that missing dates or titles are no longer “small” mistakes—they are expensive ones.
