E-Verify Resumes Operation Amid Government Shutdown

E-Verify, the U.S. Citizenship and Immigration Services (USCIS) employment eligibility verification system, is back online as of October 7, 2025, despite the ongoing government shutdown.

After a suspension of services on October 1 due to the shutdown, USCIS restored access to the system, though it remains uncertain how long it will stay operational or how this was achieved during the funding lapse.

Employers are encouraged to promptly process any backlogged queries and ensure all new hires are entered into E-Verify without delay. The system also appears to support functions like setting up new accounts, closing cases, and managing Tentative Non-confirmations (TNCs). However, it is unclear if the E-Verify employer and employee hotlines will be staffed in the coming days.

According to Dawn Lurie, a noted immigration compliance expert, “It is not surprising that the Administration found a way to return E-Verify to operational status even amid the shutdown. Given the ongoing emphasis on compliance, worksite enforcement, and employment eligibility verification, reactivating this essential tool aligns with broader policy priorities.”

No official guidance has been released regarding whether USCIS will start the three-day submission window for cases delayed during the suspension. As of 10 pm ET on October 7, no formal notice confirming the system’s reactivation has been posted.

EMP Trust HR recognizes E-Verify as a critical tool for employers aiming to maintain robust compliance programs.
